GENERAL TERMS AND CONDITIONS (GTC)
of the Museum for Franconia (MfF)
1 Validity
1.1 The following provisions apply to the purchase of all types of tickets, vouchers and participation in public guided tours at the Museum für Franken
1.2 This includes the purchase of tickets
- at the ticket office of the Museum für Franken
- in online sales.
1.3 These GTC apply in addition to the general provisions of the MfF, in particular the house rules of the MfF, as well as the respective individual instructions relating to house rules, whichcan be viewedon site at the museum or online via the website (www.museum-franken.de).By purchasing tickets, the customer* recognizes these general terms and conditions of the MfF as binding. Deviating terms and conditions of the customer shall not become part of the contract unless the MfF agrees to their validity in writing.
1.4 The tickets are only sold to end customers, otherwise there is no entitlement to the service provided by MfF on the ticket. MfF is entitled to limit the number of tickets to be sold per customer in individual cases and in online sales.
1.5 The purchase of services in accordance with the following provisions creates a contractual relationship exclusively between the customer and the MfF. Resale of the purchased tickets is not permitted.
2 Types of tickets offered
2.1 The MfF is responsible for deciding which of the following ticket types are offered for purchase.
2.2 Day ticket
A day ticket for the MfF only entitles the holder to visit the permanent collection and any special exhibition during the respective opening hours on the day of purchase, unless the type of ticket states otherwise.
2.3 Gift vouchers
Gift vouchers can be purchased at the MfF ticket office and in the webshop.
2.4 Time slot tickets
The MfF is entitled to make admission dependent on prior booking of an appointment and to sell tickets with a fixed admission or validity period (time slot tickets) in accordance with section 2.2. at its own discretion and based on objective criteria, in particular for reasons of visitor safety or for reasons of conservation. Time slot tickets only entitle the holder to admission during the admission time or period of validity printed on them. For the same reasons, tickets may be temporarily withdrawn from sale in accordance with section 2.3. If the visitor capacity is exceeded due to the number of visitors despite time slot tickets, waiting times of up to 30 minutes must be accepted.
3 Prices and payment
The admission prices as well as regulations on concessions and free admission are set out in the MfF's current admission price regulations, which can be viewedin the ticket office area and on the MfF homepage at(www.museum-franken.de) and can also be requested by calling the info telephone (0931/20594-0). The applicable currency is the Euro. Admission prices are subject to change without notice.
3.1 Tickets, vouchers and public guided tours are exempt from VAT in accordance with § 4 No. 20 a UStG.
3.2 When claiming discounts or free admission, a corresponding valid confirmation and, if applicable, an additional photo ID must be presented when purchasing at the MfF ticket office and on the day of the visit when entering the exhibition premises. Proof must also be shown on request at the entrance to the museum or exhibition. If proof cannot be provided, the difference to the full admission price must be paid in arrears.
3.3 Products purchased purely digitally (see sentence 1, section 3.4.2.2.) must be printed out by the customer before visiting the museum and/or presented in a digitally readable form (e.g. on the display of a smartphone) when visiting the museum. Admission will only be granted if the QR code is fully legible.
3.4 Payment
3.4.1 Payment at the cash desk
- Payment is made at the MfF cash desk. The payment options available are cash payment and payment by EC or credit card from most major providers (VISA, Master Card, American Express, etc.).
- When paying by EC card, the customer must ensure that there are sufficient funds in the account. Costs incurred due to chargebacks shall be borne by the customer as long as MfF is not responsible for the chargeback. In individual cases, MfF is entitled to accept only certain payment methods depending on the respective customer
3.4.2 Payment and shipping in the online store
- In the case of online sales, payment is made in advance by the customer using one of the payment methods offered. Purchase on account is not possible.
- The products mentioned in section 2 are shipped digitally by e-mail to the e-mail address provided by the customer.
4. revocation/cancellation
Products purchased at the cash registers and in the webshop may not be returned or canceled. A statutory 14-day right of revocation applies to products purchased online under section 2.3, provided that no (partial) services have yet been utilized. Note: The right of withdrawal only applies to vouchers
You have the right to cancel this contract within fourteen days without giving any reason.
The revocation period is fourteen days from the date of conclusion of the contract.
To exercise the right to cancel, you must inform us (Museum für Franken, Festung Marienberg, 97082 Würzburg, E-Mail info@museum-franken.de) of your decision to cancel this contract by a clear statement (e.g. a letter sent by post or e-mail). You can use the model withdrawal form, but this is not mandatory. Your revocation is to be sent to:

To meet the withdrawal deadline, it is sufficient for you to send your notification of exercising your right of withdrawal before the withdrawal period has expired.
Consequences of withdrawal
If you withdraw from this contract, we will reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us).We will refund all payments we have received from you, including delivery costs (with the exception of the additional costs resulting from the fact that you have chosen a type of delivery other than the cheapest standard delivery offered by us), immediately and at the latest within fourteen days from the day on which we receive notification of your revocation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this repayment.
Received vouchers are not to be returned, they will be invalidated.

Exclusion of the right of withdrawal
According to § 312g para. 2 no. 9 BGB, there is no right of withdrawal for contracts for services in connection with leisure activities if the contract provides for a specific date or period for the provision. We would therefore like to point out that there is no right of withdrawal for the purchase of admission tickets for museums and exhibitions, tickets for participation in public guided tours and other public mediation offers, for the binding order of group tours.
5 Admission and domiciliary rights
5.1 The customer must present the ticket purchased at the ticket office or in the online store (see 3.3.) in printed or digital form when entering the exhibition rooms. The ticket will be scanned at the entrance. During the visit to the exhibition rooms, the customer must carry it with them and show it to the supervisory staff on request.
5.2 MfF staff are authorized at any time to issue instructions deviating from these GTC at their own discretion on the basis of their domiciliary rights.
5.3 In the event of violation of these GTC, the house rules, the instructions of MfF staff and the MfF checkroom regulations, the MfF or its authorized representatives reserve the right to expel the customer from the museum or to impose a general ban from the premises. This also applies if the ticket holder causes a nuisance to other visitors and/or disrupts museum operations or poses a risk of disturbance.
6 Statute of limitations
The limitation period for vouchers is three years in accordance with statutory regulations, beginning at the end of the year in which the ticket was purchased

The MfF is not liable for the loss, expiry or damage of tickets or vouchers. In the event of loss or damage, there will be no replacement or refund.
8 Public guided tours
8.1 The MfF offers guided tours for a limited number of participants for a fee.
8.2 To take part in public guided tours of the MfF with limited attendance, the customer must purchase a separate guided tour ticket at the museum ticket office or online on the same day in advance of the tour. This is a prerequisite for participation in the tour. The purchase of a general admission ticket for the museum does not entitle the customer to a place on a guided tour. Proof of entitlement to participate in the guided tour does not replace the purchase of a ticket referred to in section 2.
8.3 A postponement of the dates by up to 30 minutes compared to the specified time does not entitle the customer to a reduction in the fee for the guided tour. The time will be made up by the museum guide accordingly. In the event of delays in excess of this, the guided tour will be canceled. In this case, the regulation mentioned under point 8.4. applies.
8.4 The MfF is entitled to cancel the public guided tour if there is an important reason (e.g. the lecturer is unable to attend, visitor capacity is exceeded, force majeure as per section 9.2). In this case, the participation fees already paid will be refunded for tours requiring payment. Participants are not entitled to any further claims for damages. Tickets already purchased for access to the exhibition rooms cannot be returned (see Section 4), unless there is also a reason as per Section 9.2.
9 Liability of the MfF
9.1 The MfF shall only be liable for damages caused by intent or gross negligence on the part of the MfF, its employees or vicarious agents. Any further liability, unless provided for by mandatory statutory provisions, is expressly excluded. The limitation of liability shall not apply in particular to damages resulting from injury to life, limb or health or the breach of material contractual obligations.
9.2 If, due to compelling causes within the sphere of the MfF (conservational, organizational or technical reasons) or due to force majeure (e.g. (e.g. closure orders by security authorities or authorities superior to the MfF, natural disasters, pandemics, war, etc.), the MfF is entitled to withdraw from the contract if a visit to a museum or exhibition and thus the use of tickets is not possible. In this case, the ticket price will be refunded. The MfF accepts no further liability.
9.3 As far as possible, closures will be announced in good time in advance on the MfF website.
9.4 For structural or organizational reasons, individual parts of the exhibition may be closed or certain exhibits may be inaccessible. This does not entitle to a reduction of the fee or to claims for damages.
10 Final provisions
10.1 The law of the Federal Republic of Germany shall apply exclusively, without reference to international private law. The sole place of fulfillment for performance and payment is Würzburg. The place of jurisdiction for disputes with merchants, legal entities under public law and special funds under public law as well as persons who have their domicile or usual place of residence abroad is Würzburg.
10.2 Deviations from or additions to these provisions must be made in writing. This also applies to the written form requirement itself.
10.3 MfF reserves the right to amend these GTC at any time without giving reasons. These changes shall not apply to orders already placed or existing purchase contracts.
10.4 Should individual provisions of these GTC be or become invalid or unenforceable, this shall not affect the validity of the remaining provisions. The ineffective points shall be replaced by the statutory provisions, where applicable.
